May I ask for your opinion of the following :

 

L/C called for

-         full set Multimodal bill of lading consigned to order, blank endorsed.

LC

44E: FINLAND

44F: ISTANBUL, TURKEY BY VESSEL

44B: CORLU, TURKEY

1. Beneficiary submitted 3/3 B/L indicating

Place of receipt (pre-printed wording) : BLANK

Port of loading (pre-printed wording):  HELSINKI, FINLAND

Port of discharge (pre-printed wording): ISTANBUL, TURKEY

Place of delivery (pre-printed wording): CORLU, TURKEY

Vessel: RAINBOW

 

B/L SHOWING DATE OF ISSUE : 2011-12-18

PRE-PRINTED ON BOARD NOTATION as follows :

Shipped on board date (local tiime) 2011-12-14

SEPARATE ON BOARD NOTATION as follows :

SHIPPED ON BOARD RAINBOW ON 2011-12-16 AT HELSINKI

 

Please comment whether a B/L bearing 2 on board date is acceptable or not?

I TREAT THE SEPARATE ON BOARD NOTATION

OVERRIDING THE PRE-PRINTED ON BOARD NOTATION AND

DATE OF SHIPMENT IS 2011-12-16.

UCP600, clause 20.a.ii says:

UCP600, clause 20.a.ii says: “ If the bill of lading contains the indication "intended vessel" or similar qualification in relation to the name of the vessel, an on board notation indicating the date of shipment and the name of the actual vessel is required.”

In my opinion, SHIPPED ON BOARD RAINBOW ON 2011-12-16 AT HELSINKI is acceptable by banks. According to that notation, the shipment date is 2011-12-16.

And I think it is possible to quote 02 separate on board notation like the eg you've raised. But if you just quote notation like 'Shipped on board date (local tiime) 2011-12-14", banks will consider that is a discrepancy.
