Hi,

    Paragraph no.17 of ISBP 681 says:

< The term "within" when used in connection with a date excludes that date in the calculation of the period.>

Could you give an example in this regard ?

Para 17 of ISBP

Example : "Presentation required of a copy of dated courier receipt, evidencing that a set of copy documents to be sent to the applicant within five days of B/L date".

B/L is dated 1.2.10.

My view : The receipt should be dated between 1.2.10 and 6.2.10, i.e if we exclude 1.2.10, the period of 5 days expires after 6.2.10.

    Thank you for your reply.In your example there is no any requirment  for dating  the courier receipt within five days of B/L date, but also there is a requirment, in the courier itself , for evidencing  of sending a set of copy documents  to the applicant within five days of B/L.

 date. So the date of the courier receipt does not matter .

Any comment apperciated.

Case :

Example : "Presentation required of a copy of dated courier receipt,
evidencing that a set of copy documents to be sent to the applicant within five days of B/L date".

First thing : LC calls for dated courier receipt. Hence it should be dated. In the above, if the requirement is just courier receipt instead of dated courier receipt - even in that case, from the face of the document, you should be able to determine that documents were sent to applicant within five days of B/L date and it can be determined only from the date of the courier receipt. Hence it should be dated between 1.2.10 and 6.2.10.

But actually : 'within 5 days of B/L Date ',  means it can be dated 5 days prior and after the B/L date.                              (Please refer ISBP para 16d and 17)

Eg : B/L date (date of shipment) : 15th Jul                              B/L issue date : 10th Jul

Then Courier receipt can bear any date between 10th July and 20th Jul, provided all other documents are dated prior to date of courier receipt.
