Dear specialists,

I need your advice:

We have an L/C issued by bank "x" and the advising bank is "y" . Also, l/c is available with bank "y" ( advising bank ). Assuming that the l/c is payable at sight and the presentation made is compliant with l/c terms and further advising bank sent to issuing bank documents and an MT754 message , can we consider this being a negotiation ? By sending this message MT754 , advising bank is  "negotiating bank " ?

"This message is sent by the paying, accepting or negotiating bank, or the bank incurring a deferred payment undertaking, to the issuing bank. It may also be sent by the bank to which documents have been presented to a bank that has been nominated to pay/accept.

It is used to advise the Receiver that documents were presented in accordance with the credit terms and are being forwarded as instructed."

The act of Negotiation involves the purchase of the beneficiary's documents, and it would be true to say that true negotiation would therefore involve discounting the proceeds (with or without recourse). Only then would a nominated bank be considered to have "acted" on its nomination.

In practice, very few banks (unless it is a confirming bank) truly acts on its nomination by paying out from its own funds prior to receiving settlement from the issuing bank. However, on examination of compliant documents a nominated bank is still entitled to issue an MT754, and the issuing bank is still obliged to honour, but (depending on LC terms) not necessarily until it has received and examined the documents itself.

Certainly the MT754 would provide no indication to the issuing bank as to whether the nominated bank has "acted" on its nomination. Its scope is limited to advising the issuing bank that documents are compliant and that they are being forwarded. However, whether or not the nominated bank has actually "negotiated" is immaterial to the issuing bank's obligation to pay the nominated bank, if documents are compliant.

A per my knowledge if you confirmed l/c with advising bank then bank is liable to pay you against clear l/c complied docs if l/c is not confirmed with advising or nego bank and docs dispatched complied with l/c then you will be getting payment from issuing bank within max 7 banking days.

 

Better you check with your bank trade specialist.

dear BNMORE, can you please mention the rule under which you write that issuing bank will be paying within 7 days. in the below message, the number of days is mentioned as 3. what are the exact ucp / urr / isbp rules in this respect.

So, the L/C is payable by sight and is available with advising bank. In case of a compliant presentation, the remitting bank ( advising bank ) sends the documents to issuing bank and in the same time sends an MT754 and reimburse theirselves with value date 3 working days.

Having in view the above, can we talk about the negotiation ? Is the advising bank in position of a "negotiating bank" ?

I am waiting other views over the topic !!!
