photocopy of b/l signed and stamped

Hi everyone,

pls send your comments on the following query                                          

lc calls for b/l in full set

photocopy of marked original b/l presented.

there is an original signature and stamp of  the agent on behalf of the named carrier.

IMHO, the document is discrepant because the statement appears not to apply to the document presented as per ucp 600 art 17 c.iii.

what is your comment and what would you think if the a/m b/l is also marked original

.

Original B/L - White paper B/L Not Discrepant

You can prepare the B/L in a white paper, comply all requirement of the L/C, put the stamp showing “original” or mark the word “original” by typing, sign manually or in pre printed form, signing capacity should be mention as carrier or agent,  put issuer's stamp, will consider B/L as original. This B/L will comply article 17 of UCP. No bank can say, this B/L is a discrepant document. Colour is not required for an original B/L.

IT IS ORIGIN,NOT PHOTOCOPY.

HI JIMMY,ACCORDING TO ART 17 OF UCP600,A bank shall treat as an original any document bearing an apparently original signature,mark, stamp, or label of the issuer of the document, unless the document itself indicates that it is not an original.IF  there is an original signature and stamp of  the agent on behalf of the named carrier,THE B/L MUST NOT BE photocopy.

The document is clearly discrepant. Not because of signature which appears to be original but from the fact that the contents of BL became contradictory. I would especially refer to the fact that within content of B/L is stated how many originals has been issued. IF it is stated that 3/3 was issued and you have received 3/3 photocopies of this sort anyone can see it is an inconsistency as a photocopy is a document which was reproduced from an original document which exists in one or more than one copies and which unfortunatelly is not know of its whereabout .

 

THE RISK OF ISSUING EXTRA ORIGIANL BL

I THINK THAT THE RISK ISSUING EXTRA ORIGINAL BL ?THE SIGNATURE IS REAL?WILL BE BEARED BY THE CARRIER ,NOT BENEFICIARY.

AND IN SOME CASE ,"PHOTOCOPY " IS ACCEPTABLE.

FOR EXAMPLE , THE CARRIER OF ITS AGENT ISSUED ONE BL(COMPLETE WITHOUT SIGNATURE),  HE PHOTOCOPY 2 COPIES OF THIS ONE .FINALLY ?HE SIGN 3?FULL SET?BL TO THE BEN.

IN THIS CASE ?IS IT NOT ACCEPTABLE?

I have a question. If the B/L is " TO ORDER" but not endorsed on the back side of B/L , Then will the LC applicant be able clear the Goods  

Any one , please advise !

to order b/l must be endorsed by the shipper so that the title of the goods may be passed to the endorsee (i.e. applicant in your case)
