I received one Transfer LC with special condition as "payment will be made subject to final payment of the LC applicant". I think this is not fair, is it true that this is a standard clause or I can ask to waive this clause.
Concerning docs to be presented in a Transferable LC, these must be
presented by the second beneficiary (the actor to whom the credit has
been transferred). As per art. 38-h of UCP600, the only documents that
can be changed are the Invoice and the eventual Draft.
if the documentary credit is not confirmed, the bank is right.
In any case the second beneficiry's bank , in case of l/c available by negotiation, could negotiate complied documents. Negotiation means that this bank will credit the beneficiry with its own funds.
