Dear All,

We use to take one shipment for one invoice only but in one case by mistake our CHA has taken two BLs for the cargo we need to invoice  in one single invoice only. Shipment is under LC and LC permits partial shipment.

My confusion is can two part shipments under one invoice can be considered as partial shipment as permitted under LC or part shipment means 'one invoice - one BL case' and we can not prepare one invoice for these two BLs.

i think its not a part shipment. it is important how the exporter is presenting u the documents. if the consignment was issued under the same bl by a agent but use two different vessel, will u call it part shipment? i guess no. since the importer is taking over the title of the goods all at a once, its not part shipment

Hi!

There is no any difference in Your case whether Your 2 Bs/L are constituting partial shipment or not.

As far as partial shipments are allowed and Your LC doesn't have any restriction such as "FOR EACH SEPARATE B/L THE FULL SET OF DOCS REQUIRED TO BE PRESENTED" or "EACH PARTIAL SHIPMENT TO BE COVERED BY FULL SET OF DOCS REQUIRED" etc then:

 +  You are safe to present 2 (3,4,5) separate Bs/L (or other transport docs) which constitute or not partial shipment

+ Any other docs can be presented in the same manner if there would be single B/L (i.e. single presentation). Just do not forget to make additional reference  in docs for all the Bs/L.

I've done in such a way dozen times collecting transport docs and presenting together in order to save some utilization costs.

Moreover there is no any restrictions in this case provided by UCP 500 or 600.

As long as the cargo is moving in same vessel/voyage this should not be treated as partial shipment.   If your LC allows partial shipment, then there is no need of panic as the bank can not treat it as discrepancy in either way.

Contact Issuing bank for approval

Kapil,

This is a partial shipment. You, through your bank,  can contact Issuing bank for pre-approval of this discrepancy.

Even though 2 BLs issued, if the vessel would have been same on both BLs, it would not have been a discrepancy.

Don't worry

Partial shipment were allowed, so there is absolutely no problem unless there is something SPECIAL in the credit as ARMAGEDO has written.

I think Ajit has simply overseen that partial shipments were allowed.
