Bill of Lading (notify party and Port of Discharge)

LC calls for: Non-negotiable copy of the bill of lading, showing consignee as XXXXX, market freifgt prepaid and notify: XXXXX.

Presented Bill of Lading indicates consignee as XXXXX (which fully corresponds to the LC terms) and notify party as: "SAME AS ABOVE".

question 1: "SAME AS ABOVE" quotation in the notify party section is acceptable or should it indicate XXXXX (i.e. full name and address as stated in consignee section)?

LC calls for port of discharge to be: Poti, Georgia. 

presented Bill of Lading shows in the port of discharge section: Poti

question 2: quotation "Poti" is acceptable or should it quote "Poti, Georgia" as stipulated in the credit?

Discrepancies

The second question has previously been the subject of ICC opinions, and agreed that absence of country would not necessarily make the document discrepant. I say "necessarily" because in some cases (Tripoli, Libya and Tripoli, Beirut, as an example) it may be necessary  to stipulate the country, but this would depend on the context.  

As regards the first question, I would not consider this a discrepancy.

One more question concerning the non-negotiable sea waybill.

 

The credit calls for : “non-negotiable copy of  sea waybill”.

While checking the presented document I referenced to
ISBP  article 20, which clearly says:

“Where a credit allows for the presentation of a copy
transport document rather than an original, the credit must explicitly state
the details to be shown. Where copies (non-negotiable) are presented, they need
not evidence signature, dates, etc.”

However UCP 600 article 21 (non-negotiable sea waybill) says:

a.      
A non-negotiable say waybill, however named,
must appear to:

i)                   
Indicate the name of the carrier and be signed
by…

 

 

The presented document under the L/C
is not signed.

Please provide me with your point
of view.
