What is the purpose of Certificate of Re-export origin instead of calling cretificate of origin?
Clause in 46A
CERTIFICATE OF VIETNAM ORIGIN OR RE-EXPORT ORIGIN IN 3 FOLD ISSUED/ATTESTED BY LOCAL CHAMBER OF COMMERCE STATING THE FULL NAME AND ADDRESS OF THE MANUFACTURER.
Please explain the key point in above mentioned clause.
I came accross the C/O re-export with Hongkong businesses only. Huu Duc will know much better with Vietnam as he is our absolute Vietnamese expert.
Usually this certificate confirms that the goods origin from another state than that of the port of loading and that the goods were only transferring that country. In Hongkong there was always a special stamp of the CICL in field 4, stating that the goods were not processed during their stay in Hongkong.
Preferential matters were regularly affected, as we also always had Chinese GSP C/Os form A from the Chinese Mainland.
However, I haven't seen them for quite a while now. Maybe because of the repatriation of Hongkong to China?

To tell the truth, my comment was based on the answer by Japan Ministry of Finance to the complain of Tokyo CCI with regards to generalized system of preferences certificate of origin and certificate of re-export origin for the product of Chinese origin imported into Japan through Hong Kong.
Perhaps the explanation by Japan Ministry of Finance is no longer needed as Hong Kong became part of China under the “One Country, Two System” formula in 1997.
In Vietnam, to be eligible for particular preferential tax rates set by the Minister of Finance, for goods imported from countries, groups of countries or territories offering particular preferential import tax to Vietnam importers must submit C/Os evidencing the origin of the goods. However, preference tax rates is also applied in case importers present back -to- back C/Os granted by intermediary member countries which are non- origin countries. Back-to-back C/Os are issued based on the original C/Os issued by the origin countries. Customs offices shall check back-to-back C/Os according to origin checking process issued by general Director of Customs.
Once again, to tell the truth I am not really good at the issue in question.

As far as I know, the issue is concerning preferential tariff. For preferential tariff to apply, it is necessary for the importer to submit to the Customs a preferences certificate of origin (Form A) stating that the cargo is a product from the country to which his country applies a preferential tariff.
In case the cargo is imported into the importer’s country from the preferred country that is origin via a non-origin country, for preferential tariff to apply, the importer is required to submit a re-export origin certificate or a re-loading certificate issued by the customs of the non-origin country.

Hi,
If the importer fails to prove that the product is of the origin from a preferred tariff country, the preferential tariff will not be applied or in the worse case scenario it may not be allowed to be imported into the country.
