Minor Typos

Hi All Friends,

 

Please advise me about the minor typos on the documents. Such as to type " CONTACT " i/o of " CONTRACT " on invoice or " 100.PCT " i/o " 100.00PCT ". No where in the LC stated that minor typos are acceptable.

 

Please refer any article or reference if and where possible.

Typing errors

Hi,

Where there is no express stipulation in the LC, you may refer to UCP and ISBP. Regarding misspelling or typing errors, you are  recommended to refer to ISBP para. 25.

I do not think words in your example make the documents discrepant if read in the context of the description in the credit.

Dear Imran Umer ! My view is that the parties issuing the docs required should take care in all respects to consider the writing as given in the LC. Why to risk any discussion with advising bank, opening bank and applicant relating to typos ? This topic has created ICC publications and opinions as far as I know, but from daily business I only recommend -> avoid any problem and write the details even against Your own feeling for the language. Maybe UCP 600 Art. 18c in connection with 14d (!) and e  and ISBP 681 Para 2 (first sentence - risk of ambiguity) and Para 5 (careful attention) help further on. But if typos are NOT acceptable this is a condition to be considered in strict compliance. But this is my personal view, others are highly appreciated. Have a further good time. rgds Kurt.

Careful consideration must be taken when looking at one particular paragraph of the ISBP and the UCP.  Remember any examiner must look at the rules, document and procedures as a whole.

Standard practice is that if the typo does not change the meaning of the word or the understanding fo the document, it should be acceptable.  The above example showing "100.00PCT" and "100.PCT" mean the same thing. 

The other example is much more difficult to determine on its own.  Since the word is "contact" instead of "contract" the examiner must take into account the overarching meaing.  Let me give you the two following scenarios to better explain.

Scenario 1:

The merchandise description calls for the phrase "goods as per contract no. 110022".  If the typo is "goods as per contact no. 110022" then typo should not be considered a discrepancy.

 Scenario 2:

The merchandise description calls for the phrase "goods contract adam smith".  If the typo is "goods contact adam smitn" then typo should may be considered a discrepancy, depending on other information on the document.  Remember the document must be examined as a whole and if under the contract number in a pre-printed field the wording "adam smith" appeared, it should be acceptable.

Once again, remember that the acceptance or rejection of the typo must be done with the view of the whole document presented.
