Hi all,
I'm sure everyone on this forum, as L/C practitioners, has seen L/Cs in which it is plainly evident that the issuing bank does not have a clue about their terms and conditions. What is the general reaction to starting a "name and shame" forum with simple points like the bank's name, the erroneous requirement, why it is erroneous, and the solution sought, such as:
ABC Bank in Blah has requested "B/L to show that grain shipped is free of weed seeds" - the B/L is a document covering the carriage of goods, not describing their condition which would be unknown to the carrier - solution, request the L/C be amended to delete this requirement.
My hope is that as the readership of this forum expands, the guilty banks might see their name and actions and realise they need to change their procedures.
What does everyone think about this?
Regards,

Hello Bob
I think you may create a problem if specific parties are named. You may be can talk about trends or even aspects of a given trading area/country: but I would be cautious about actual entities.
I believe that, having set up the site "Peter", should be the definitive voice on this...

Name & Shame
Hi Bob
Whilst the aim is sound, personally I'm a bit wary of such an approach. It could be perceived as a form of vigilanteism, and the reputation of the bank's other ancilliary services may be indirectly and perhaps unfairly tainted as a result.
As a comprison, you may be aware that ICC opinions never disclose the identity of the complainee (is there such a word?), only the complainant, probably for this very reason.
I would be intersted to hear other's views.
Name and Shame
Hi Abrar,
I see your point. Maybe we could just contribute to a growing list of strange clauses or requirements, without naming the banks concerned, still in the hope that they might read them and actually understand the error of their ways. Just maybe, over time, we would see an improvement. I know, I live in a dream world!

Bob
