Hi everyone,
i'll whould like to know your opinion about the following issue:
imagine that i have a B/L signed by a company named "ship trade, ltd", saing that is "acting as Carrier" and in the same box saing is acting as "As Agent for the carrier "ship trade, ltd". being the same entity, with the same name act as both parties? or in another way they cannot act in same party, because an entity cannot act simultaniously as Carrier and as Agent?
Thanks for your replies!
Regards
Hi friend,
I think that your case falls in the content of a.o. opinion:Where a party signed in its own name as agent for a carrier of the same name was this a discrepancy?
Signature box
Signed as agent for the Carrier(PREPRINTED )
AS AGENT FOR THE CARRIER (ADDED TEXT)
ABC CO LTD
For and on behalf of (STAMP WITH SIGNATURE)
ABC CO LTD
(SIGNATURE)
Authorized signature
-----------------------------------------------------------------
Authorized Signatuure (PREPRINTED)
The conclusion was:
We can find no reason for refusal of a bill of lading that is signed in the manner shownunder "query".However, from the information provided, it is not clear whether the bill of lading indicated the name of the carrier. This may only be determined from the transport document itself.
My Thought is that in some part of the bill of lading ABC CO Ltd has to be indicated as Carrier.
So, please contact someone that has the opinion, I think is still valid, but check it with or in your bank.
Other comments appreciated
Ciao
Thanks for your reply.
Regards.
